Terms & Conditions

Welcome to Bumf (operated under Pick Out Right Store, a sole proprietorship registered in the Philippines). By accessing or using the Bumf mobile application, website, or related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Platform.

1. Definitions

  • "Bumf" / "We" / "Us" / "Our" refers to the Bumf platform operated by Pick Out Right Store.
  • "User" refers to customers ordering meals through the Platform.
  • "Meal Provider" refers to restaurants, home cooks, or merchants offering meals.
  • "Rider" refers to independent delivery partners using the Platform.
  • "Wallet" refers to the in-app balance used by Riders for platform fees.

2. Platform Overview

Bumf is a marketplace platform that connects Users, Meal Providers, and Riders. Bumf does not prepare food, provide delivery services directly, or employ Riders or Meal Providers.

PART A: Terms for Users (Customers)

3. User Eligibility

  • You must be at least 18 years old to use the Platform.
  • You agree to provide accurate and complete information.

4. Orders and Payments

  • Prices are set by Meal Providers.
  • Delivery fees are determined by Riders or shown in the app.

5. Cancellations and Refunds

  • Once a meal is prepared or dispatched, cancellations may not be allowed.
  • Refunds, if any, are subject to Meal Provider policies.

6. Food Safety Disclaimer

  • Meal Providers are responsible for food quality, safety, and compliance with health regulations.
  • Bumf is not liable for food-related illness, allergies, or reactions.

PART B: Terms for Riders

7. Rider Status (Independent Contractor)

  • Riders are independent contractors, not employees, agents, or partners of Bumf.
  • Riders control their own schedule and accept deliveries voluntarily.
  • Riders are responsible for their own taxes, government contributions, and permits.

8. Rider Wallet System

  • Riders must maintain a Bumf Wallet balance.
  • A platform fee is deducted automatically when a rider accepts a delivery: ₱5 for short trips (≤0.5 km) and 15% of the delivery fee for long trips.
  • Riders cannot accept deliveries if wallet balance is below the required minimum.

9. Wallet Top-Up (Manual GCash)

  • Riders top up their wallet by sending payment to the designated GCash number.
  • Top-ups are credited after manual or system confirmation.
  • Wallet balances are non-refundable unless required by law.

10. Delivery Obligations

Riders agree to:

  • Deliver orders safely and promptly
  • Handle food with care
  • Act professionally toward Users and Meal Providers

PART C: Terms for Meal Providers

11. Merchant Responsibilities

Meal Providers agree to:

  • Provide accurate menu details and pricing
  • Prepare food safely and hygienically
  • Comply with local food safety laws

Bumf is not responsible for:

  • Food quality or preparation
  • Merchant licensing compliance

PART D: General Terms

12. Communication

  • In-app chat may be used between Users, Riders, and Meal Providers.
  • Abusive, illegal, or spam messages are prohibited.

13. Account Suspension

Bumf may suspend or terminate accounts for:

  • Violating these Terms
  • Fraud or abuse
  • Illegal activities

14. Limitation of Liability

To the maximum extent allowed by law:

  • Bumf is not liable for indirect, incidental, or consequential damages.
  • Bumf does not guarantee uninterrupted service.

15. Data Privacy

User data is handled in accordance with the Data Privacy Act of 2012 (RA 10173).

16. Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

17. Changes to Terms

Bumf may update these Terms at any time. Continued use of the Platform means acceptance of the updated Terms.
